McCondichie v Mains Medical Centre

Case Report: 2004 Rep L.R. 4
Scottish Courts Service: Decision in the Outer House dated 31 October 2003.

The facts: The claimant was injured when she slipped and fell in an icy car park.

Decision: The court found that there was a suitable system in place for the treatment of the ice, and it had been properly implemented. The claim therefore failed.

Comment: This is a standard example of ice clearing cases that are regular court fodder and generally involve employees suing their employers for unsafe workplace conditions. The same standards are unlikely to apply in the case of icy conditions in car parks and footpaths in remoter parts of the countryside.
